Acceptance of Terms. This Terms and Conditions of Use Agreement (the "Agreement") sets forth legally binding terms for your use of Website. Member Account, Password and Security. You must be at least 18 to become a Member of our Website. If you register to become a Member, you will be required to choose a password and user name, and you may be asked for additional information regarding your Account, such as your email address. You agree to provide true, accurate, current and complete information about yourself as prompted by the registration form (the "Registration Data") and maintain and promptly update your Registration Data to keep it true, accurate, current and complete. For safety reasons, we recommend that your user name should not contain your last name (in addition, rather than your actual first name, you may want to consider using a word or term with meaning to you). You are responsible for maintaining the confidentiality of the password and account information, and are fully responsible for all activities that occur under your password and Account. You are required to (a) immediately notify B-cycle (email: info@bcycle.com) of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you log out from your account at the end of each session. B-cycle will not be liable for any loss or damage arising from your failure to comply with this paragraph. Use of and registration for the Website are void where prohibited.

Leader Board. When you register for the Website, we will give you the option to permit us to display your user name on the Website's "Leader Board." The Leader Board displays publicly visible statistics of some individual Members relating to the Member's use of the Service. If you choose to permit us to infringed on the intellectual property rights of B-cycle or of a third party, or otherwise violated any intellectual property laws or regulations. B-cycle's policy is to investigate any allegations of copyright infringement brought to its attention. If you have evidence, know, or have a good faith belief that your rights or the rights of a third party have been violated and you want B-cycle to delete, edit, or disable the material in question, you must provide B-cycle with all of the following information: (a) a physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works; (c) identification of the material that is claimed to be infringed or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit B-cycle to locate the material; (d) information reasonably sufficient to permit B-cycle to contact you, such as an address, telephone number, and if available, an electronic mail address at which you may be contacted; (e) a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Term and Termination. This Agreement will remain in full force and effect for so long as it is accessible through the Website. If you wish to terminate your membership, please follow the instructions on the FAQ page for the Website or email us at info@bcycle.com. B-cycle reserves the right to terminate your 
Account or your access to our Website immediately, with or without notice to you, and without liability to you, if B-cycle believes that you have breached any of the terms of this Agreement, furnished B-cycle with false or misleading information, or interfered with use of the Website by others.

Disclaimer of Warranties. You expressly understand and agree that:
YOUR USE OF THE WEBSITE IS AT YOUR SOLE RISK. THE WEBSITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Indemnity. You agree to indemnify, defend, and hold harmless the B-cycle Parties from any and all third party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from or relating to your breach of the terms of this Agreement or your use of the Website. B-cycle will notify you promptly of any such claim, loss, liability, or demand, and will provide you with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage, or cost.

Additional Terms. We may also require you to follow additional rules, guidelines or other conditions ("Additional Terms") in order to participate in certain promotions or activities available through our Website, to obtain certain premium Content through our Website, or for other reasons. These Additional Terms will be posted on the relevant portions of our Website or on the portions of our Website that describe the specific promotions, Content, or activities. These Additional Terms are part of this Agreement, and you agree to comply with them when you participate in those promotions, purchase items from our online stores, or otherwise engage in activities governed by such Additional Terms.

Modification and Discontinuation. Choice of Law and Forum. This Agreement and the relationship between you and B-cycle will be governed by the laws of the State of Wisconsin without regard to its conflict of law provisions. You and B-cycle agree to submit to the personal and exclusive jurisdiction of the courts located within Madison, Wisconsin.

Waiver and Severability of Terms. The failure of B-cycle to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.

Limitation on Actions. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Websites or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Except as prohibited by law, B-cycle may share your personal information: (i) with the operators of our Websites and bicycle rental programs; (ii) third parties for advertising or marketing purposes, (iii) if B-cycle is required by law to do so, (iv) in the event of a transfer of ownership of B-cycle, merger or other similar transaction, or (v) as otherwise set forth in this Privacy Policy. We may share certain personal information with third parties for advertising, promotional and other purposes regarding products and services that we think may be of interest to you. BIKE SHARE TERMS AND CONDITIONS, RIDER'S RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY AND HOLD HARMLESS.

Rider should CAREFULLY READ all terms and conditions before entering this Agreement.

1. Purpose of Agreement
This document constitutes the entire Agreement ("Agreement") between (a) Rider, the person agreeing to lease and use the bike ("Bike"), and (b) BIKE SHARE OF AUSTIN ("AUSTIN B-CYCLE").

2. General Rental and Use of Bike: Agreements and Restrictions

2.1	Rider is sole user: AUSTIN B-CYCLE expressly agrees to let, and the Rider expressly agrees to take on, rental of the Bike subject to the terms and conditions set out herein. AUSTIN B-CYCLE and the Rider are the only parties to this Agreement. The Rider is the sole lessee and is solely responsible for compliance with all terms and conditions contained herein. Rider may not enter into this Agreement unless Rider is of legal age to form a binding contract with Austin B-cycle OR Rider's parent or legal guardian has read and accepted this agreement on Rider's behalf.

2.2	Rider is 13 years or older: Rider represents and certifies to AUSTIN B-CYCLE that Rider is at least 13 years old and is riding on the AUSTIN B-CYCLE pass designated for their age. If Rider intentionally or unintentionally misrepresents Rider's age, Rider accepts full responsibility and is liable for any consequence, claims, demands, causes of action, losses, liabilities, damages, injuries, costs and expenses, penalties, attorney's fees, judgments, suits or disbursements of any kind or nature whatsoever related to any such intentional or unintentional misrepresentation.

2.3	Rider is a competent bike operator: Rider represents and certifies that he/she is physically fit to ride the Bike and also that Rider is familiar with the operation of the Bike, and is reasonably competent to ride the Bike.

2.4	Bike is exclusive property of AUSTIN B-CYCLE: Rider agrees that the Bike and any equipment attached thereto, at all times, remain the exclusive property of AUSTIN B-CYCLE. Rider will not make any type of modification to the Bike at any time.

2.5	Bike Operating Hours and Bike Availability: Rider agrees and acknowledges that the Bikes are available 24 hours/day, 7 days/week, 365 days/year. Bikes must be rented within the maximum rental time limits set forth in 2.6 below. Bikes are limited and Bike Stations may not have available Bikes for rental at all times. To check the availability of Bikes, please refer to the rental locations and Bike availability on http://Austin.Bycle.com.

2.6	Maximum Rental Time and Charges: The maximum rental time is 24 hours. Rider agrees that Rider will return the Bike to a designated AUSTIN B-CYCLE bike station within no more than 24 hours from the time that rental of the Bike began. Rider may then rent again. Rider agrees that he/she is solely responsible for being aware of any elapsed time related to the timely return. Bike Rental Charges in addition to any access or member fee per trip are: 0-60 minutes: NO CHARGE, each subsequent 30 minutes: $4 plus sales tax.  The maximum day usage charge is $75.00 plus sales tax and is based on a 24 hour period from the start of the trip. Upon return of the Bike, the Rider will be charged the accumulated rental charges, or the maximum day charge; whichever is less. If the Bike is not returned within 48 hours, it will be considered stolen, and the Rider will be charged $1,200.00 plus sales tax. Applicable local and state sales tax of 8.25% is included in rental charges.		

2.7	Bike may be used and/or operated only in the City of AUSTIN. Rider agrees to only use, operate and/or ride the Bike in the City of AUSTIN. Rider will not, under any circumstances, remove the Bike from the City of AUSTIN.

2.8	Rider must follow rules of use and/or operation of Bike: Rider agrees to follow all laws pertaining to the use, riding and/or operation of the Bike, including all state and local laws and the rules and regulations pertaining to bicycles in the City of AUSTIN. Riders under the age of 18 must wear a bicycle helmet while riding per the City of Austin helmet ordinance, Section 12-2-31.

2.9	Rider must not use, ride and /or operate Bike if impaired: Rider agrees that he/she will not, under any circumstances, use, ride and/or operate the Bike if he/she has consumed, ingested and/or used alcohol or drugs and/or has a blood concentration above the jurisdictional limit prescribed.

2.10	Bike is intended for only limited types of use: Rider agrees that he/she will not use the Bike for racing, mountain bike riding, stunt or trick riding. Rider agrees that he/she will not operate and/or use the Bike on unpaved roads, through water, or in any location that is prohibited, illegal and/or a nuisance to others. Rider agrees that he/she will not use the Bike for hire or reward, nor use it in violation of any law, ordinance or regulation.

2.11	Rider's use of front carrier/basket is limited: Rider agrees that he/she will not fill the front carrier/basket with heavy items as they may create an unsafe condition and affect Rider's balance and steering control. Rider acknowledges that the front carrier/basket of the Bike is intended to carry light goods only, and will not carry additional people or animals in the basket or anywhere on the Bike.

2.12	Rider must report accident, stolen or lost Bike and/or B-cycle Membership Card: Rider agrees that he/she must immediately report to AUSTIN B-CYCLE and the AUSTIN Police Department an accident, involving a Bike. Rider agrees that he/she will report a lost/stolen B-cycle Member Card to AUSTIN B-CYCLE. Rider agrees that he/she is responsible and liable for any misuse, consequences, claims, demands, causes of action, losses, liabilities, damages, injuries, costs and expenses, penalties, attorney's fees, judgments, suits or disbursements of any kind or nature whatsoever related to a stolen or lost Bike and/or B-cycle Membership Card. The cost of a replacement B-cycle Membership Card is $5 per card.

2.13	Rider responsibility related to Bike use and damage: Rider agrees to return the Bike to AUSTIN B-CYCLE in the same condition received, ordinary wear and tear expected. At checkout, rider is responsible for checking bike to ensure there is no damage to bike and reporting any such damage to Austin B-cycle via the customer service number on the bike handlebars. Rider agrees to ensure that the Bike is always locked and secured when unattended. Bikes are equipped with wire locks; however, AUSTIN B-CYCLE will not be responsible for any lost, stolen, destroyed and/or damaged Bike under any circumstances, regardless of whether Bike locks are used, broken or not properly functioning. Rider may not use private or third party locks to secure the bike, and AUSTIN B-CYCLE reserves the right to cut any private or third party lock used to secure the bike.  Rider agrees to pay for any damage, including replacement parts, to and/or destruction or loss of the Bike not reported at initial checkout of the bike (Rider agrees to pay for any loss even though damage was caused by someone else). All repairs needed as a result of any such loss, destruction or damage will be performed at the normal labor rates. In the event the Bike is lost, destroyed or damaged beyond repair, regardless of fault or cause, Rider agrees to pay AUSTIN B-CYCLE the full replacement value of the equipment.

2.14	Abandoned Bike: Rider agrees to securely dock Bike at an AUSTIN B-CYCLE bike station at the end of their trip. A Bike that is not returned at the end of the Rider's trip or is left unattended without being secured with the provided lock is considered an abandoned bike. Rider will be charged a fee of $25 per hour for staff time with a 1 hour minimum for a abandoned Bike recovered by AUSTIN B-CYCLE staff.

3.	Waiver and/or Limitation of Liability

3.1	For and in consideration of rental and use of the Bike, Rider specifically forever releases and relinquishes and discharges AUSTIN B-CYCLE, B-cycle, LLC, the City of AUSTIN, all Sponsors as well as owners of property upon or near which stations are located ("Released Parties") from any and all claims, liability, cause (s) of action and/or damage or wrongful death, injury to others and/or third parties, which arise out of, result from or relate to this Agreement; the rental, maintenance, design, use and/or operation of the Bike; the B-cycle program, and/or its website, including any and all claims, liability, cause(s) of action and/or damages related to the sole or partial negligence of Released Parties and/or the negligence of others. By this Agreement any such claims, rights, and causes of action that Rider (and Rider's legal guardian(s), if applicable) may have are hereby waived, released and relinquished, and Rider (and guardian(s), if applicable) does(do) so on behalf of Rider's heirs, executors, administrators and assigns.

3.2	Rider expressly agrees to indemnify, release and hold harmless Released Parties from all liability for any such property loss or damage, personal injury or loss of life, whether caused by the sole or partial negligence of AUSTIN B-CYCLE, the Released Parties and/or the negligence of others, whether based upon breach of contract, breach of warranty, active or passive negligence or any other legal theory, in consideration for using and/or operating the Bike.

3.3	Rider voluntarily agrees not to sue Released Parties, understands and recognizes that Rider will have no right to make a claim or file a lawsuit against Released Parties arising out of this Agreement, the rental, maintenance, design, use and/or operation of the Bike, the AUSTIN B-cycle program, and/or this website, in consideration for using and/or operating the Bike.

3.4	This Agreement is governed by the applicable laws of TEXAS. If any provision of this Agreement is found to be unenforceable, all other provisions will be given full force and effect.

4.	Acceptance of Agreement and Terms and Conditions by Rider: Rider expressly acknowledges that he/she has carefully read the entire Agreement, including the Terms and Conditions, and understands this Agreement, including, but not limited to, the Waiver and Liability, Assumption of Risk and Indemnification Provisions fully and expressly agrees to be bound by this Agreement. After careful deliberation, Rider voluntarily gives his/her consent and expressly agrees to all the conditions included in this Agreement as set forth above. Rider has read, understands and expressly agrees to the above Agreement and Terms and Conditions.

BIKE SHARE ACUERDO DEL USUARIO TERMINOS Y CONDICIONES, DESLINDE DE RESPONSABILIDAD DEL CICLISTA, ASUNCION DE RIESGO, INDEMNIZACION Y EXONERACION DE RESPONSABLIDAD.
El ciclista debe leer CON CUIDADO todos los terminos y las condiciones antes de comprometerse a este acuerdo.

1.  Proposito del Acuerdo Este documento, Acuerdo del Usuario, constituye la totalidad del Acuerdo ("Acuerdo") entre (a) el Ciclista ("Ciclista"), la persona que alquila y utiliza la bicicleta ("Bicicleta") y (b) [BIKE SHARE OF AUSTIN ("AUSTIN B-CYCLE").

2.  Alquiler General y Uso de la Bicicleta: Acuerdos y Restricciones.

2.1  El Ciclista es el unico usuario: AUSTIN B-CYCLE expresamente consiente al, y el Ciclista expresamente consiente a encargarse del, alquiler de la Bicicleta sujeto a los terminos y las condiciones especificados en el presente documento.  AUSTIN B-CYCLE y el Ciclista son las unicas partes de este Acuerdo. El Ciclista tiene la responsabilidad absoluta de cumplir con todos los terminos y las condiciones especificados en este documento. El Ciclista no puede entrar en este Acuerdo a menos que el Ciclista es la edad legal para formalizar un contrato vinculante con AUSTIN B-CYCLE o el padre o tutor legal del Ciclista ha leido y aceptado este acuerdo en nombre del Ciclista.

2.2  El Ciclista es de al menos 13 anos de edad: El Ciclista representa y certifica a AUSTIN B-CYCLE que el ciclista tiene por lo menos 13 anos de edad y esta operando la bicicleta en la AUSTIN B- ciclo superado designado para su edad. Si el Ciclista intencionalmente o involuntariamente falsifica la edad del Ciclista, el Ciclista acepta la responsabilidad absoluta por cualquier consecuencia, reclamo, demanda, derecho de accion, perdida, responsabilidad, dano y prejuicio, lesion corporal, costo y/o gasto, cuota penal,  honorario de abogado, fallo, peticion o pago por desembolso de cualquier tipo o forma que sea relacionado con dicha falsificacion de edad intencional o involuntaria.

2.3  El Ciclista es un operario competente de bicicleta: El Ciclista certifica y representa que esta en la condicion fisica apropiada para andar en Bicicleta y que esta familiarizado con la operacion de la Bicicleta y que es razonablemente competente para andar en Bicicleta.

2.4  La Bicicleta es el patrimonio exclusivo de AUSTIN B-CYCLE: El Ciclista acuerda que la Bicicleta, y el equipo adjunto a la misma, en todo momento, es el patrimonio exclusivo de AUSTIN B-CYCLE. El Ciclista no modificara la Bicicleta de ninguna forma ni en ningun momento.

2.5  Horas de Operacion y Disponibilidad de la Bicicleta: El Ciclista acuerda y reconoce que las Bicicletas estan disponibles 24 horas al dia, 7 dias a la semana, 365 dias al ano. Las Bicicletas deben ser alquiladas dentro de las horas limites especificadas en 2.6 abajo. Las bicicletas son limitadas y es posible que las Estaciones de Bicicleta no tengan Bicicletas disponibles en todo momento. 2.6  El plazo maximo de alquiler es 24 horas. El Ciclista conviene en devolver la Bicicleta a una estacion designada de AUSTIN B-CYCLE dentro de 24 horas desde la hora en que empezo el alquiler de la Bicicleta. El Ciclista podra entonces alquilar de nuevo. El Ciclista acepta que el/ella es exclusivamente responsable por estar consciente del tiempo que transcurre relacionado al regreso oportuno. Los costos del Alquiler de Bicicleta son 0-60 minutos: ninguna tarifa, 30 minutos adicional: $4. El costo maximo por dia es $75 y se basa en un periodo de 24 horas desde el inicio del viaje. Al devolver la bicicleta, el Ciclista sera cobrado los costos de alquiler acumulados o el cobro diario maximo; cualquier que sea menos. Si la bicicleta no ha sido devuelto dentro de 48 horas, se lo considerara un robo y el Ciclista sera cobrado $1,200.00. Impuestos locales y estatales aplicables de 8.25% seran cobrados ademas de los costos de alquiler y reemplazo.

2.7  Se puede utilizar y/o operar la Bicicleta solamente en la ciudad de Austin. El Ciclista acuerda utilizar y/o operar la Bicicleta exclusivamente en la ciudad de Austin. El Ciclista no, bajo ninguna circunstancia, quitara la Bicicleta de la ciudad de Austin.

2.8  El Ciclista debe seguir las reglas del uso/operacion de la Bicicleta: El Ciclista acuerda seguir todas las leyes pertinentes al uso, y/o operacion de la Bicicleta, incluyendo todas las leyes estatales y locales y las normas y las reglas pertinentes a las bicicletas en la ciudad de Austin. Los ciclistas menores de 18 anos deben llevar un casco como lo exige la ordenanza Seccion 2.12.31 Ciudad de Austin.

2.9 El Ciclista no debe utilizar y/o operar la Bicicleta si esta en un estado alterado: El Ciclista acuerda que no, bajo ninguna circunstancia, utilizara y/o operara la Bicicleta si ha consumido, ingerido y/o utilizado alcohol o drogas y/o si tiene una concentracion de sangre mas alto del limite jurisdiccional declarado. 

2.10  La Bicicleta es ideada solamente para ciertos tipos limitados de uso: El Ciclista acuerda que no utilizara la Bicicleta para echar carrera, montar en las montanas, ni para practicar el ciclismo acrobatico.  El Ciclista acuerda que no operara ni utilizara la Bicicleta en las carreteras no pavimentadas, por el agua, en ningun lugar prohibido, ilegal y/o que sea una molestia a los demas. El Ciclista acuerda que no pondra la Bicicleta para alquiler, que no la utilizara para hacer beneficios, y que no la utilizara en la violacion de ninguna ley, ordenanza ni reglamento. 

2.11  Se limita el uso de la cesta: El Ciclista acuerda que no llenara la cesta con cosas pesadas que podran crear una condicion insegura y afectar el equilibrio o el control del Ciclista. El Ciclista reconoce que la cesta de la Bicicleta es ideada solamente para transportar cosas ligeras y el/ella no intentara transportar personas adicionales ni animales en la cesta ni en ninguna otra parte de la Bicicleta. 

2.12  El Ciclista informara de un accidente, de una Bicicleta robada o perdida y/o de la perdida de una Tarjeta del Usuario de B-cycle: El Ciclista acuerda que les informara inmediatamente al AUSTIN B-CYCLE y al Departamento de Policia de Austin de un accidente involucrando una Bicicleta. El Ciclista acuerda que le informara al AUSTIN B-CYCLE de una Tarjeta del Usuario perdida/robada. El Ciclista acuerda que es responsable de cualquier uso incorrecto, consecuencia, reclamo, demanda, derecho de accion, perdida, responsabilidad, dano y prejuicio, lesion corporal, costo, cuota penal, honorario de abogado, fallo, peticion, o pago por desembolso de cualquier tipo o forma relacionado a una Bicicleta robada o perdida y/o a la perdida de una Tarjeta del Usuario de B-cycle. Una Tarjeta del Usuario de B-cycle cuesta $5 por tarjeta.

2.13  La responsabilidad del Ciclista relacionado con el uso de, y el dano a, la Bicicleta: El Ciclista acuerda devolver la Bicicleta a AUSTIN B-CYCLE en la misma condicion en la cual la recibio, salvo el desgaste natural o normal. Cuando el Ciclista recibe la Bicicleta, el Ciclista debe buscar cualquier dano a la Bicicleta y reporta el dano al servicio al cliente. El Ciclista acuerda asegurar que la Bicicleta siempre este cerrada con llave y protegida cuando no este bajo la vigilancia del Ciclista. Es posible que las Bicicletas sean equipadas con cerraduras de cable; sin embargo, AUSTIN B-CYCLE no sera responsable de ninguna Bicicleta perdida, robada, destruida y/o danada bajo ninguna circunstancia, sin importar si se usen las cerraduras de Bicicleta o no, y sin importar si las cerraduras esten rotas y/o si no funcionen. El Ciclista no puede a usar otra cerradura y AUSTIN B-CYCLE cortara otras cerraduras que se utiliza. El Ciclista acuerda pagar por cualquier dano que no se reporta cuando recibe la Bicicleta, incluyendo refacciones,  y/o la destruccion o la perdida de la Bicicleta (El Ciclista acuerda pagar por cualquier perdida/dano aunque sea causado por otra persona). Todos los arreglos necesarios como resultado de cualquier perdida, destruccion o dano, se llevaran a cabo de acuerdo con las tarifas de labor normales. Si la Bicicleta se pierde, se destruye o se dana irreparablemente, sin importar la culpa ni la causa, El Ciclista acuerda compensarle a AUSTIN B-CYCLE el valor completo del reemplazo del equipo.

2.14 Una Bicicleta que se abandona: El Ciclista acuerda que devolver la Bicicleta a una estacion de B-cycle cuando su viaje esta completo. Cuando la Bicicleta no devolver a la estacion o cerrada o este bajo la vigilancia del Ciclista, la Bicicleta se abandona. El Ciclista sera cobrado $25 por cada hora que un miembro del personal de AUSTIN B-CYCLE trabaja encontrar la Bicycleta.

3.  Renuncio y/o Limitacion de Responsabilidad 

3.1 Para y en contraprestacion del alquiler y del uso de la Bicicleta, El Ciclista especificamente y para siempre libera y desiste y exonera a AUSTIN B-CYCLE, a B-cycle, LLC, a la Cuidad de Austin, a todos los patrocinadores de AUSTIN B-CYCLE tal como a los duenos de la propiedad en la cual o cerca de la cual estan localizadas las estaciones ("Partes Exoneradas"), de cualquier y todo reclamo, responsabilidad, derecho(s) de accion y/o dano y perjuicio o muerte por negligencia, herida infligida sobre otros y/o terceras partes, que surja de, resulte de o que relacione a este Acuerdo; el alquiler, mantenimiento, diseno, uso y/o operacion de la Bicicleta; el programa de B-cycle, y/o su pagina de Internet, incluyendo todo reclamo, responsabilidad, derecho(s) de accion y/o dano y perjuicio relacionado a la negligencia exclusiva o parcial de las Partes Exoneradas y/o la negligencia de otros. Por este acuerdo cualquier reclamo, derecho, y derecho de accion que el Ciclista (y el Tutor Legal del Ciclista si se aplica) tenga esta, por el presente documento, exonerado, liberado y renunciado, y el Ciclista (y su Tutor Legal si se aplica) hace esto de parte de los herederos, albaceas, administradores y causahabientes del Ciclista.

3.2  El Ciclista conviene en indemnizar, y mantener libre a las Partes Exoneradas de toda responsabilidad de cualquier perdida o dano de propiedad, lesion personal o perdida de vida, sin importar si sea causado por la negligencia exclusiva o parcial de AUSTIN B-CYCLE y/o la negligencia de otros, sin importar si se base en la ruptura de contrato, la ruptura de garantia, la negligencia activa o pasiva o cualquier otra teoria legal, en contraprestacion de utilizar y/o operar la Bicicleta.

3.3 El Ciclista voluntariamente acuerda, entiende y reconoce que el Ciclista no tendra ningun derecho a hacer ningun reclamo ni a presentar una demanda contra las Partes Exoneradas que derive de este Acuerdo, el alquiler, el mantenimiento, el diseno, el uso y/o la operacion de la Bicicleta, el programa de B-cycle, y/o su pagina de Internet, en contraprestacion de utilizar y/o operar la Bicicleta.

3.4  Este acuerdo se regira por las leyes aplicables del Estado de Texas. Si cualquier provision de este acuerdo se declare inaplicable, todas las otras provisiones se encontraran en vigencia plena. 

4. Aceptacion del Acuerdo y de los Terminos y las Condiciones por el Ciclista: El Ciclista expresamente reconoce que el/ella ha leido cuidadosamente el Acuerdo entero, incluyendo los Terminos y las Condiciones y que entiende este Acuerdo, incluyendo, pero no limitandose a, la Renuncia y Responsabilidad, La Asuncion de Riesgo y las Provisiones de Indemnizacion y plenamente y expresamente acepta los terminos de este Acuerdo. Despues de deliberarse cuidadosamente, El Ciclista voluntariamente da su consentimiento y expresamente acuerda a todas las condiciones incluidas en este Acuerdo y expuestas arriba. El Ciclista ha leido, entiende y expresamente acepta el Acuerdo y los Terminos y las Condiciones arriba. Es posible que este acuerdo sea modificado de vez en cuando, y cualquier modificacion tomara efecto una vez que aparezca en nuestra pagina de Internet o en cualquier lugar a traves del cual usted puede ver nuestra pagina de Internet. El Ciclista acuerda cumplir con cualquier modificacion a este acuerdo despues de que aparezca dicha modificacion en nuestra pagina de Internet; por lo tanto, es importante que usted consulte este Acuerdo con regularidad. Como usuario registrado, intentaremos avisarle por correo electronico cuando modifiquemos los terminos de este Acuerdo. 

Este acuerdo entra en vigor el 18 de enero 2017.
